Description of Proposal: This proposal identifies approximately 23 total acres of clearing and grading activities within the Ten Trails (a/k/a The Villages) Master Planned Development Miner's Ridge Expansion Parcel to establish the alignment and grading for the construction of a roadway and associated utilities. The roadway alignment will provide access to project-related stormwater facilities and to future development areas as the MPD continues to progress. The associated clear and grade activities support the MPD requirement of maintaining a 20% cut/fill balance for each Phase of the MPD.
Location of Proposal: The site is located within a portion of the Miner's Ridge expansion parcel of the Ten Trails (a/k/a The Villages) Master Planned Development (MPD) within the City of Black Diamond, south of the existing Ten Trails MPD Phase 2A Plat. The project includes portions of the following unaddressed King County parcel numbers: 222106-9007, 222106-9008, 222106-9010, 222106-9047, 222106-9054, 222106-9055, 222106-9056, and 222106-9057.

The lead agency for this proposal has determined that, with the implementation of the mitigation measures identified below, it will not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C. After review of the completed environmental checklist and associated documents/reports, the lead agency has determined this proposal will not have a probable significant adverse impact on the environment if the mitigation measures set forth below are implemented:
1. A Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to the City's MDRT prior to commencing site development activities.
2. A Spill Prevention, Control, and Countermeasure Plan (SPCC) shall be submitted to, and approved by, the City's MDRT prior to commencing site development activities.
3. A Level 2 Tree Plan pursuant to Black Diamond Municipal Code (BDMC) 19.30 shall be submitted to, and approved by, the City's MDRT prior to commencing site development activities. An approved Forest Practices Approval issued by the Department of Natural Resources shall be required in association with the Level 2 Tree Plan application.
4. An emergency access path shall be provided within 150 feet of any vegetation stockpiles. The emergency access path shall provide a minimum of 20-foot unobstructed all-weather vehicular access and shall provide for emergency vehicle turnaround.
5. The project footprint is limited to that approved by the associated Clear & Grade Permit (City File PUB25-0064) and Road & Utility Permit (PUB25-0065).

Public Commenting: This MDNS is issued under WAC 197-11-350. The Lead Agency will not act on this proposal for 14 days from the date of this notice. All documents associated with this proposal are available to review upon request to the Agency Contact listed above. Interested parties may also submit comments on this proposal to the Agency Contact. Comments on this proposal are requested within 14 days of this notice and should be submitted by 4:30pm on April 28, 2026.
Appeals: Pursuant to WAC 197-11-680(3)(a)(v), there is no administrative appeal provided by the City for this SEPA threshold determination because the City has not provided an administrative hearing or appeal on the underlying government action (which are unappealable Type 1 Decisions under the municipal code, as vested to this proposal). Any appeal of this decision would be to the superior court under RCW 43.21C.075 and RCW 36.70C and must be filed within 21 days of this notice.
