SUMMONS IN A CIVIL ACTION
To: David Alan Capito II, aka Vyacheslav Arkangelskiy, aka Ryan Smith

You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after the 28th day of April 2025, and defend the above entitled action in the above entitled court and answer the complaint of the plaintiffs, and serve a copy of your answer upon the undersigned attorney for the plaintiffs at his office below stated; and in case of your failure to do so, judgment will be rendered against you according to the demand of the complaint which has been filed with the clerk of said court.

In their complaint, plaintiffs allege that your improper access to and use of plaintiffs' confidential information caused them harm. Plaintiffs' causes of actions include claims under the Federal Computer Fraud and Abuse Act, 18 U.S.C. 1030, and invasion of privacy, among others. They allege damages against you, which includes damages from loss of their jobs.

2025 INDEPENDENT SALARY
COMMISSION SALARY SCHEDULE

The City of Auburn Independent Salary Commission, pursuant to Auburn City Code Section 2.08.060 establishes the following salary schedule for the City of Auburn Councilmembers:

1. The Councilmember's salary shall be increased from $1,667.18 per month to $1,800.00 per month ($21,600.00 annually).

2. The Councilmember selected as Deputy Mayor shall have their salary increased from $2,222.90 per month to a total of $2,400.00 per month ($28,800.00 annually).

3. In addition to the City Councilmember compensation specified above, Councilmembers who are appointed by the Mayor to serve on regional boards, commissions, and committees on behalf of the City shall receive an additional payment of $55.00 per meeting for attendance at the meetings of such regional boards, commissions, or committees, up to a maximum of four (4) meetings per month and a maximum of $220.00 per month as described in Auburn City Code Section 2.51.020(B).

The effective date of the salary schedule is June 16, 2025, subject to filing a valid referendum petition with the City Clerk within thirty (30) days after the official filing date of the salary schedule.
