NOTICE OF TRUSTEE'S SALE: Pursuant to the Revised Code of Washington, Chapter 61.24 RCW: I. NOTICE IS HEREBY GIVEN that the undersigned Trustee, Craig G. Russillo, Schwabe, Williamson & Wyatt will on FRIDAY, DECEMBER 19, 2025, at 11:00 A.M. at the following location: on the front steps at the main entrance of the King County Courthouse, 516 Third Avenue, Seattle, WA 98104, sell at public auction to the highest and best bidder, payable at the time of sale, the following-described real property situated in the County of King, State of Washington, to wit: Lot 6, Block 23, Burien Lake View Tracts No. 4, according to the plat thereof recorded in Volume 23 of Plats, Page 50, in King County, Washington; situate in the City of Burien, County of King, State of Washington, commonly known as 429 SW 153rd St., Burien, WA 98166 (Tax Parcel ID No.: 122000 0905): TRUST DEED INFORMATION: The afore-described real property is subject to that certain Deed of Trust, dated July 7, 2017, and recorded on July 7, 2017, under Auditor's File No. 20170707000890, records of King County, Washington. Grantor: Burien Oral & Maxillofacial Surgery LLC. Beneficiary: KeyBank National Association. Original Trustee: Fidelity National Title Company of Washington, whose address is 600 University St., Suite 2424, Seattle, WA 98101. Successor Trustee: Craig G. Russillo, c/o Schwabe, Williamson & Wyatt PC, 1420 Fifth Ave., Suite 3400, Seattle, WA 98101, was appointed Successor Trustee on July 21, 2025, pursuant to an Appointment of Successor Trustee recorded on July 21, 2025, under Auditor's File No. 20250721000004. II. No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any court by reason of the Borrower's, Grantor(s)' or any successor-in-interest's default on the obligation secured by the Deed of Trust. DEFAULT: III. The defaults for which this foreclosure is made are as follows: failure to make required monthly payments under the Promissory Note in the amount of $30,944.14, plus late fees in the amount of $3,869.69; and failure to pay property taxes. AMOUNT DUE: IV. The sum owing on the Note is Principal of $589,331.13 together with interest accrued through September 17, 2025, in the amount of $24,524.42, and accruing at the daily rate of $130.14; plus late fees of $3,869.69; plus a prepayment penalty of $5,893.31; plus attorney fees and costs, including title fees, in the amount of $7,905, and additional attorney fees and costs as provided in the Deed of Trust and as are provided by statute. DATE AND TIME OF SALE: V. The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on FRIDAY, DECEMBER 19, 2025, at 11:00 A.M. The default(s) referred to in Paragraph III must be cured by Monday, December 8, 2025 (11 days before the sale date), to cause a discontinuance of the sale. VII. The Trustee whose name and address are set forth below will provide in writing to anyone requesting it, a statement of all costs and fees due at any time prior to the sale. VIII. The effect of the sale will be to deprive the Grantor and all those who hold by, though or under the Grantor of all their interest in the above-described property. IX. Anyone having an objection to the sale on any grounds whatsoever are afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to the Revised Code of Washington, Chapter 61.24.130. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060. Notice to Guarantor: The Guarantor may be liable for a deficiency judgment to the extent the sale price obtained at the Trustee's Sale is less than the debt secured by the Deed of Trust. In any action for a deficiency, the Guarantor will have the right to establish the fair value of the property as of the date of the Trustee's Sale, less prior liens and encumbrances, and to limit its liability for a deficiency to the difference between the debt and the greater of such fair value or the sale price paid at the Trustee's Sale, plus interest and cost. The Guarantor has the same rights to cure the default or repay the debt as is given to the Grantor(s) in order to avoid the Trustee's Sale. The Guarantor will have no right to redeem the property after the Trustee's Sale. Any action to enforce a guaranty must be commenced within one year after the Trustee's Sale, or the last Trustee's Sale under any Deed of Trust granted to secure the same debt (subject to such longer periods as are provided in RCW 61.24).
