Project Description:
The County was issued an SSDP (SSDP2016-00415) on January 31, 2019, to upgrade 3.5 miles of the interim East Lake Sammamish Trail (ELST). Culvert replacements, stream realignment, and stream habitat restoration on George Davis Creek (GDC) were approved as part of the broader trail project in the permit. These GDC-related project elements were designed to be constructed at the same time as the City's adjoining stream restoration project, which is both downstream and upstream of the County's project. Private-property litigation associated with the City's portion of the GDC improvements delayed both the City's and the County's projects. Following the City's completion of litigation in 2024, the GDC projects have resumed; however, the SSDP the County obtained is set to expire on January 31, 2026. Construction on the City's and County's projects will have to be constructed during the in-water work window in 2026; therefore, the work cannot begin until after the permit expiration date.
King County is requesting a one-time extension of Shoreline Substantial Development Permit SSDP2016-00415 under WAC 173-27-090 and a permit revision as authorized by WAC 173-27-100(2). The county will replace two functionally deficient culvert crossings on George Davis Creek (GDC) under East Lake Sammamish Trail (ELST) and East Lake Sammamish Shore Lane NE (ELSSL), with fish passable culverts, and the paved interim trail will be widened to match the rest of the ELST.
The project will result in fish passage being restored to previously inaccessible spawning habitat upstream of the trail crossings. Design for this work was originally completed along with the entire ELST South Sammamish Segment B project, and environmental permits were obtained from the City of Sammamish (City) and state and federal regulatory agencies for the entire segment. Occurring downstream and upstream of the County's project, the City's project includes approximately 700 linear feet of new stream alignment from Lake Sammamish to upstream of the East Lake Sammamish Parkway (ELSP), including replacing the ELSP culvert with a fish passage crossing structure. Due to private property litigation associated with the City's portion of the GDC culvert replacements and stream realignment, the projects were delayed and environmental permits obtained by King County have expired. Following City's completion of litigation in 2024, the GDC projects have resumed, and King County is updating GDC culvert and stream design in collaboration with the City's culvert replacement and stream re-alignment project.

- Permit Condition # 15: The time requirements of WAC 173-27-090 shall apply, except that, based on the requirements and circumstances of this project, the authorization to conduct development activities under the SSDP [SSDP2016-00415] shall terminate seven (7) years after the effective date of this permit. All extension and tolling allowances in WAC 173-27-090 will be available to the applicant.
Clearing and Grading Permit Issuance Date – CG2016-03470: 11/06/2019
- Permit Condition # 1: In accordance with SMC 16.15.070(4)(b) the East Lake Sammamish Trail Segment 2B Clearing and Grading (construction) Permit, File #CG2016-03470, shall expire concurrently with the project Shoreline Substantial Development Permit File #SSDP2016-00415 on January 31, 2026, as stipulated by the City of Sammamish Hearing Examiner Decision issued on January 31, 2019, unless King County Parks requests and the City of Sammamish grants an extension before the expiration date.
