WAC 197-11-970 SEPA DETERMINATION OF NONSIGNIFICANCE (DNS)

Description: Proposed amendments to Kenmore Municipal Code (KMC) Title 12 include new and revised code sections. New code sections include: Construction Intent (KMC 12.05.015), Removal of Facilities/Equipment in City Rights-of-Way (KMC 12.05.040), and Violation Enforcement; Penalty (KMC 12.05.050). Minor additions to existing code sections KMC 12.35 and KMC 12.55 were also added. The draft code changes are provided as an attachment to the SEPA checklist. This is a non-project City-wide code amendment.
The City of Kenmore, as lead SEPA agency, has determined that the above-referenced proposal does not have a probable significant adverse impact on the environment. The lead agency has determined that the requirements for environmental analysis, protection, and mitigation measures have been adequately addressed in the development regulations and comprehensive plan adopted under chapter 36.70A RCW, provided by RCW 43.21C.240 and WAC 197-11-158. An environmental impact statement (EIS) will not be required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public upon request.
Issuance Date: December 8, 2017.
This DNS is issued under WAC 197-11-340. The lead agency will not act on this proposal for 14 days from the issuance date. Comments must be submitted no later than December 22, 2017 per WAC 197-11-340(2)(a) and KMC 19.35.100. Comments should be filed at Kenmore City Hall; 18120 68th Ave NE; PO Box 82607; Kenmore, WA 98028. A non-project DNS is not subject to administrative appeal per Section 19.35.160 of the Citys adopted Environmental Procedures.
