NOTICE OF APPLICATION FOR A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT AND DETERMINATION OF NONSIGNIFICANCE


Notice is hereby given on 2/6/18 and 2/13/18, that an application for a Shoreline Substantial Development Permit and SEPA review was submitted for the Marina Container Village project to locate container retail uses at four potential sites on the Marina floor. The application (file no. LUA2017-0045) will be reviewed pursuant to chapter 16.20 Des Moines Municipal Code (DMMC).
Notice is hereby given on 2/13/18 that the City of Des Moines Responsible SEPA Official has determined that the proposed project does not have a probable significant adverse impact on the environment. This decision was made after review of a completed environmental checklist and other information on file with the lead agency. Written comments concerning the DNS may be submitted to the PBPW Department, located at 21630 11th Avenue South, Suite D, Des Moines, WA 98198, by 4:30 p.m. on 03/07/18. Comments should discuss specific environmental issues associated with this proposal and identify how the DNS does or does not address those issues.
The decision to issue the DNS may be appealed by filing an appeal consistent with Sections 16.05.300 and 18.240.170, if applicable, of the Des Moines Municipal Code (DMMC). Appeals must be complete and filed with the City Clerk by 4:30 p.m., on 03/19/18. The appeal letter must cite specific procedural errors, omissions, environmental impacts, inaccurate environmental information or failure to comply with specific adopted policies or codes which dispute the validity of the DNS.
Written comments specifically concerning the application for the SSDP may be submitted to the City of Des Moines PBPW Department at 21630 11th Avenue South, Suite D, Des Moines, WA 98198, by 4:30 p.m. on 3/7/18. All appeals of any final permit decision are governed by the procedures established in RCW 90.58180, RCW 90.58.140(6), and WAC 481-03, the rules and procedures of the Shorelines Hearings Board. All appears must be made to the Shorelines Hearings Board within twenty-one (21) days after the Citys final decision concerning the permit.
