WAC 197-11-970 SEPA DETERMINATION OF NONSIGNIFICANCE (DNS)

Description: Amendments to Kenmore Municipal Code (KMC) relating to the North Subarea of the Regional Business zone (RB North), to continue the temporary elimination of the road impact fee and minimum parking space requirements for changes of use of existing buildings in such zone. The proposed pilot program has been expanded to include the elimination of frontage improvement requirements for changes of use of existing buildings in such zone. A similar pilot program effective from 8/5/2015 through 12/31/2016 proved successful. A continuation and expansion of that program is intended to promote the retention of existing businesses and the creation of new businesses. The project proposes amendment of KMC Sections 18.40.035 and 20.47.035 and create new KMC code Section 12.50.180 (see attached draft ordinance).
The City of Kenmore, as lead SEPA agency, has determined that the above-referenced proposal does not have a probable significant adverse impact on the environment. The lead agency has determined that the requirements for environmental analysis, protection, and mitigation measures have been adequately addressed in the development regulations and comprehensive plan adopted under chapter 36.70A RCW, provided by RCW 43.21C.240 and WAC 197-11-158. An environmental impact statement (EIS) will not be required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public upon request.
This DNS is issued under WAC 197-11-340. The lead agency will not act on this proposal for 14 days from the issuance date. Comments must be submitted no later than May 5, 2017 per WAC 197-11-340(2)(a) and KMC 19.35.100. Comments should be filed at Kenmore City Hall; 18120 68th Ave NE; PO Box 82607; Kenmore, WA 98028. A non-project DNS is not subject to administrative appeal per Section 19.35.160 of the Citys adopted Environmental Procedures.
